In this edition we highlight several pieces of updated and new guidance issued by sector regulators: the Charity Commission for England and Wales have published updated guidance on finding and appointing new trustees, following reports that personal contacts are disproportionately used in recruiting new board members, as well as an Annual Return 2025 ‘question guide’ to help charities better understand the questions being asked in this year’s Return; the Fundraising Regulator has issued new guidance to ensure charitable cash collections are performed in ways which reduce the risk of fraud.
We also detail some upcoming changes to Scottish Charity Law, concerning the register of charity trustees, publication of annual accounts without redaction, and automatic disqualification rules. The team in our Edinburgh office have set out ways in which Scottish charities can prepare for these changes now.
Finally, we draw attention to recent sector discussion, regarding the ever-increasing risk of cyber fraud and the ways organisations can mitigate the risks, and Parliamentary debate over whether there is a need to ban ‘commissions’ being charged by online fundraising platforms for processing and collecting Gift Aid on behalf of charities.
