The Gavel Drop: GOSH Workers win Discrimination Case in the Court of Appeal

A group of around 80 cleaners at Great Ormond Street Hospital (GOSH) successfully won an appeal at the Employment Appeal Tribunal after initially losing their claims.
The cleaners had argued that they had suffered indirect race discrimination because, when their roles were brought in-house, they were placed on less favourable pay and benefits than NHS “Agenda for Change” terms. The EAT upheld their appeal, finding that the delay in extending NHS terms was discriminatory.
Why it matters:
- Indirect discrimination risk at transfer: Employers need to ensure that bringing work in-house doesn’t create two-tiered terms that adversely impact particular groups.
- Practical implications – HR and operations teams should proactively plan and document equalisation of pay and terms when transitioning staff to eliminate discrimination risks.
